@ericodom You never addressed my question as to how states may create secondary laws against the second amendment a law more important than the second amendment is The Supremacy Clause of the United States Constitution (Article VI, Clause 2) establishes that the Constitution, federal laws made pursuant to it, and treaties made under its…[Read more]

    • “…..You never addressed my question as to how states may create secondary laws against the second amendment….”
Easy answer: States can pass any laws they like. Once these laws become effective, then a challenge can be initiated in Federal court. The court challenge could takes years to before a final ruling by the Supreme Court (If they even…[Read more]

      • This I understand I’m just curious why the NRA and ACLU haven’t challenged it I mean this is what they take donations for. Additionally, actually the states may not issue laws that interfere with federal law if there is a conflict the federal law takes precedence. People Argue that the second amendment grants right to carry firearms…[Read more]

        • You are actually confusing two different types of “laws”. There are “Constitutional” laws and there are “Federal” laws, although they are not necessarily mutually exclusive. I will attempt to give an example of each (generically speaking). A “State” passes a law banning gun ownership. Bam! It is struck down. Gun ownership is protected by the 2nd…[Read more]

          • The Supremacy Clause of the United States Constitution (Article VI, Clause 2) establishes that the Constitution, federal laws made pursuant to it, and treaties made under its authority, constitute the supreme law of the land.

            1
            • So yes the state can make the but according to supremacy clause the federal law takes precedence it could make a law if there was no federal law on the table for marijuania but since thier is the states have violated that federal law

              1
            • see the secondary issue you have is that those same states civilians can be arrested by a federal officer for violation of controlled substance act this discrepancy in enforcorcement violates the The Equal Protection Clause part of the Fourteenth Amendment to the United States Constitution. , provides that no state shall deny to any person within…[Read more]

          • @ernestsegui – Again you are confusing “Federal Law” and “Constitutional” law

            • No i believe you are misinterpreting it this means that all federal laws created by the authority granted to the federal government by the constitution. Not only matters concerning the constitution.

              1
            • can anybody weigh in on this matter ?

              1
          • You are forgetting the 10th amendment. Under your logic, “Federal law is supreme”, there would be no need for state, county and local governments. The Feds would rule it all.
Again, this is an issue that has been debated and numerous court rulings handed down going both ways. Will you and I “settle” this issue? Hardly. but it is a great discussion.

            0
            • well that is the case, as a matter of fact every state constitution has clause enumerating this Also
in the case of California v. ARC America Corp., 490 U.S. 93 (1989), the Supreme Court held that if Congress expressedly intended to act in an area, this would trigger the enforcement of the Supremacy Clause, and hence nullify the state action. The…[Read more]

            • Both cases refer to the law making ability of Congress. Under the Constitution, Congress is prohibited from making laws that fall outside the enumerated powers contained there in. Like I stated before, that is the reason we have the Federal court system to resolve such issues. I’m sure, if I researched it, I could find several court cases where…[Read more]

      • nothing to due with interstate commerce the controlled substance act is what gives the D.E.A. Authority to disregard it is to disband the D.E.A.(Drug Enforcement Agency )

        • see now that opens up a whole can of worms if the state makes a law saying it residents do not have to pay federal income tax does the state law trump the federal law ?

          0
          • see personally i got nothing against it im pro marijuania hungry sleepy tired are the side effects im just saying that from a legal perspective the ruling makes absolutly no sense

            0
          • No…because the US Constitution permits Congress to levy taxes

            0
            • the same congress that made the federal law on marijuania the court just ruled that the state may override them do you see the conflict and why it is such a serious matter plus the federal government cant collect taxes from the state individuals legally if the income was generated from the sale of federally illegal substance

Thanks to @ericodom for this one.

Donald Trump and Hillary Clinton are in a bar. Donald leans over, and with a smile on his face, says, “The media are really tearing you apart for That Scandal.”

Hillary: “You mean my lying about Benghazi?”
    Trump: “No, the other one.”

@ericodom Question Eric: how do I get rid of the annoying bar for sharing on other social media sites on the left side of the screen ?

    0
    • You can’t. We want this site shared with other social sites to bring more people in.

      0
      • Could you perhaps reposition it so it doesn’t block text on the screen? Like on the bottom? I’d rather scroll more than have to “look through” something. Thanks.
